Progetto di Ricerca: La ricerca ha ad oggetto la funzione sociale del diritto in particolare l'impatto del ‘socialismo giuridico’ nel diritto commerciale italiano tra la fine dell'Ottocento e i primi anni del Novecento. L'indagine si concentra sul rapporto tra elaborazione teorica e prassi applicativa, trovando il proprio punto terminale e di verifica nell'analisi delle sentenze. In questo quadro, si evidenzia come le istanze sociali si siano radicate con particolare evidenza in specifici istituti, tra i quali spicca la disciplina delle società commerciali. La ricerca intende verificare in che misura l'interazione tra dottrina e magistratura abbia offerto strumenti per la tutela dei soggetti deboli, rimodulando i tradizionali schemi individualisti consacrati nel diritto privato e commerciale tradizionali.

Research Project: This research examines the social function of law, focusing specifically on the impact of ‘legal socialism’ on Italian commercial law between the late nineteenth and early twentieth centuries. The investigation centers on the relationship between theoretical development and judicial practice, finding its analytical endpoint and empirical verification in the study of case law. Within this framework, it is evident that social demands became most visibly embedded in specific legal institutions, among which the regulation of commercial companies stands out. This study aims to verify the extent to which the interaction between legal scholarship and the judiciary provided instruments for the protection of vulnerable parties, thereby reshaping the traditional individualistic paradigms enshrined in classical private and commercial law.
